Bond Assessments

What is a bond assessment?

A bond assessment investigation begins with a personal interview of the defendant under the scope of the factors allowed pursuant to MCR 6.106(F). The information collected is verified to ensure the accuracy of statements made by the defendant. Personal or telephone contacts with employers, counselors, spouses or family members, landlords, probation/parole officers, community members, and courts are the primary sources used to verify the information. Criminal and driving histories are also typically obtained and examined.

Factors Considered

The information considered relevant in establishing a bond and bond conditions includes:
  • Prior criminal record
  • Record of court appearances/nonappearances
  • Substance abuse history
  • Mental condition
  • Reputation of dangerousness
  • Seriousness of the offense
  • Probability of conviction
  • Presence of threats
  • Employment status and history
  • Availability of responsible members in the community to vouch for or monitor the defendant
  • Ties to the community
  • Length of residence
  • Family ties
  • Other factors bearing on risk of nonappearance or danger to the public

Report & Recommendation to Judge

A written report and recommendation is provided to the court before the defendant's arraignment. The report considers and reflects the factors in MCR 6.106(F) so the judge or district court
magistrate has the necessary information for establishing bond.
